spousal consent

noun

The consent of a spouse who is not on title, allowing the spouse on title to sell the home.

The Family Law Act requires a seller to have the consent of the spouse in order to sell a matrimonial home if the spouse is not also on title.

One common situation where a spouse may not be on title is when one person owns a home before marriage, then becomes married and their partner moves into their home.
