
spousal consent
The Family Law Act requires a seller to have spousal consent in order to sell a matrimonial home. (This only applies when the spouse is not on title - if they were on title, they would be signing the Agreement of Purchase and Sale anyway. A common situation where the spouse is not on title is when one person owns a home, then later on becomes engaged or married and their partner moves in with them.)
